I am using an unlocked 5310 XpressMusic v 09.42, RM-304 with the latest firmware from November and an ATT SIM.

I am NOT getting a signup option though from what I can find I should be able to with no problem? All I am trying to do is register for an account - which should be able to be done from an Ovi web page. Forget the webmail UI. It would be nice to just be able to signup for the actual account. I am trying to test this with Nokia Messaging.

Hello,
Please note that the US-variant of S40 phones use a different email client (Oz) and so do not support Ovi Mail. We are working on making Ovi Mail work with US-variant S40 phones as well around mid 2009. Thank you for your patience.
